Please read these Terms of Service (Terms) carefully before submitting any forms, information and/or digital media to Every Pig Rescue Service (EPRS). These Terms govern your access to, and use of, our services. Our services are available for your use only on the condition that you agree to the Terms set forth below and laid out in our privacy policy. If you do not agree to all of the Terms do not submit any forms, digital media or other information. By submitting your information to us via form, email, or any other method of communication, you and any entity you are authorised to represent signify your agreement to be bound by the Terms.

Additional Terms and Conditions may apply upon adoption of any animal via the services of EPRS.

These Terms may be subject to modification at any time without notice. Your continued use of the services provided following the posting of changes to these Terms will mean you accept those changes.

These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any dispute you have which relates to these Terms of Service, or your use of the services provided by EPRS will be subject to the exclusive jurisdiction of the courts of England and Wales.

Our services are only available to those aged 18 years or older.

Do not misuse our services. For example, do not interfere with our services or try to access them using a method other than the interface and the instructions that we provide. You may use our services only as permitted by law. We may suspend or stop providing our services to you if you do not comply with our Terms or if we are investigating suspected misconduct.

Do not introduce any malicious code, viruses, trojans or malware or otherwise disrupt services.

Do not breach or attempt to breach and security or authorisation processes.

Using our services does not give you ownership of any intellectual property rights in our services or the content you access. You may not use content from our services unless you obtain permission from its owner or are otherwise permitted by law. These Terms do not grant you the right to use any branding or logos used in our services. Do not remove, obscure or alter and legal notices displayed in or along with our services.

No harassment, threats or abuse of any kind will be tolerated towards any members of our organisation, or affiliated parties, and may result in immediate termination of all communication with, and access to, the services of EPRS.

Successfully achieving the aims of EPRS necessitates the collection, processing, storage, use and public sharing of certain personal information from persons requesting our services to either rehome or adopt an animal via our organisation. For full details on how we govern the use of your personal information in accordance with UK GDPR please carefully read our Privacy Policy. Accepting these Terms of Service means you also accept the terms of our Privacy Policy.

All information provided to us must be true and accurate to the best of your knowledge. If any piece of information provided to us is subsequently found to be inaccurate or subject to change you should notify us immediately.

All photos, videos or other digital media submitted must be your own and not infringing on any third party’s rights.

Any photographs, videos or other digital media submitted to EPRS will be subject to ongoing use by our organisation. EPRS does not claim ownership over your photographs, videos or other digital media, however, in submitting them to us you grant EPRS a perpetual, irrevocable, worldwide, royalty-free, non-exclusive transferable licence to use, reproduce, modify, adapt, create derivative works from, publicly perform, publicly display, distribute, make and have made your photographs, videos or other digital media (in any form and any medium, whether now known or later developed) as necessary to provide the service.

Engagement with the services of, and adherence to the Terms of, EPRS does not necessarily guarantee a successful or satisfactory outcome for users. The wellbeing of animals is at the forefront of all of our practices, standards and decisions. We reserve the right to refuse to either rehome any animal via our services, or make available to any person an animal for adoption, via our services. Users are expected to make reasonable financial contributions towards any costs incurred in any animal rehoming process in which that user is involved.

You can terminate use of our services at any point but we reserve the right to contact the relevant animals welfare organisations and pass along any information you may have provided us if we suspect in any way that harm may come to an animal.

In no event shall EPRS, nor any of its trustees, volunteers or members, be liable to you for anything arising out of or in any way connected with your use of our services, whether such liability is under contract, tort otherwise, and EPRS, including its trustees, volunteers and members, shall not be liable for any indirect, consequential or special liability arising out of or in any way related to your use of our services. This includes but is not limited to:

  • Any harm that comes to you or any person from any animal obtained via our services.
  • Any damage which may come to any land or property as a result of any animal obtained via our services.
  • Any harm and damage incurred as a result of the transportation of any animal obtained via our services.
  • Any costs you may incur caring for animals obtained via our services.
  • Any harm, damages or other issues which may arise as a result of following any of the guidance or information provided anywhere on www.everypigrescue.org.uk
  • Any harm, damages or other issues which may arise as a result of communications or interactions with any trustee, volunteer or member of EPRS. Every reasonable effort will be made on the part of EPRS to vet, train and limit the behaviours of its member to that which meets the expected standards of our organisation. If any trustee, volunteer or member is found to be in violation of our standards all reasonable efforts will be made to either rectify the behaviours at issue and any situations which may arise as a result, or, if necessary, our relationship with members at fault will be terminated.
  • Any harm, damages or other issues which may arise as a result of communications or interactions with any third parties which may come as a result of the use of our services, including but not limited to any persons or organisations to whom direct contact was established by EPRS.
  • Any harm, damages, misinformation or other issues which may arise from interactions with any third party websites to which links are included on www.everypig.org. EPRS takes no responsibility for any information provided by third parties.

You hereby indemnify to the fullest extent EPRS from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including reasonable legal fees)arising out of or in any way related to your breach of any of the provisions of these Terms.

If any provision of these Terms of Use is found unenforceable or invalid under any applicable law, such unenforceability or invalidity, shall not render the Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.
